This Digital Millennium Copyright Act Policy describes how kutokae responds to notices of alleged copyright infringement and how copyright owners may submit such notices. kutokae respects the intellectual property rights of others and expects users of the platform to do the same.
1. Notification of Alleged Copyright Infringement
If you believe that content available on or through kutokae.pro infringes one or more of your copyrights, please notify our designated copyright agent by providing a written notice that includes all of the following information:
- A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has allegedly been infringed.
- Identification of the copyrighted work or works claimed to have been infringed. If multiple copyrighted works are covered by a single notification, a representative list of such works is acceptable.

- Information reasonably sufficient to permit kutokae to contact you, including your name, mailing address, telephone number, and email address.

- A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright that is allegedly infringed.

3. Counter-Notification
If you believe that material you posted on kutokae.pro was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our designated copyright agent. Your counter-notification must include all of the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of an appropriate judicial forum for any dispute arising from the counter-notification.
Upon receipt of a valid counter-notification, kutokae will forward it to the original complaining party. If the original complaining party does not file a court action within the applicable period following receipt of the counter-notification, kutokae may, at its discretion, restore the removed or disabled material.
4. Repeat Infringers
kutokae reserves the right to terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. A repeat infringer is a user who has been notified of infringing activity more than once or whose submitted content has been removed from the platform more than once due to copyright infringement.
5. Misrepresentation
Please be aware that submitting a DMCA notice or counter-notification that contains material misrepresentations may result in liability for damages, including costs and attorneys' fees. If you are uncertain whether the material you are reporting constitutes copyright infringement, we recommend consulting with a qualified legal professional before submitting a notice.
6. Modifications to Infringing Material
kutokae reserves the right to remove or disable access to any content that is alleged to infringe a third party's copyright, without prior notice and at its sole discretion. kutokae is not required to notify the user who posted the content before taking such action.
